BrainShift Terms of Service

Overview

These Terms of Service (“Terms”) govern your use of BrainShift, an iOS app provided by Chipmunk Studio (“we,” “us,” or “our”).

By downloading or using BrainShift, you agree to these Terms and to our BrainShift Privacy Policy. If you do not agree, do not use the app.

These Terms apply only to BrainShift. Other Chipmunk Studio apps may have separate terms.

Using BrainShift

You may use BrainShift only in compliance with these Terms, applicable law, and Apple’s terms for the App Store and your device.

BrainShift uses Apple’s Screen Time frameworks to provide optional, user-controlled monitoring and app-blocking features. You choose which features to enable, what to select, and when to change or revoke permission. Feature availability can vary by device, operating-system version, region, Apple Account, and Apple-provided authorization.

Do not rely on BrainShift to guarantee that an app, website, device, or service will always be unavailable. Keep access to communication, safety, work, accessibility, and other services you may need.

Local data and privacy

BrainShift does not provide a Chipmunk Studio account, cloud database, or cross-device sync for your BrainShift data. Your detailed activity history, settings, user-authored Plans, Screen Time information, and Health information are handled on your device. BrainShift sends limited product analytics, which you can disable in Settings, as described in our BrainShift Privacy Policy.

Deleting, resetting, or replacing the app or device can remove locally stored BrainShift data. Restoring a purchase does not restore or merge your local app data from another device.

BrainShift Plus purchases

BrainShift offers optional BrainShift Plus access through Apple’s App Store. At launch, the reference prices are US$9.99 per month, US$49.99 per year, and US$99.99 for a one-time lifetime purchase. Actual price, currency, taxes, availability, and offer eligibility are shown by Apple before purchase and control if they differ.

Monthly and yearly plans are auto-renewable subscriptions. Eligible users may receive a seven-day free trial, as shown at checkout. Unless you cancel at least 24 hours before the trial or current billing period ends, your subscription renews automatically. Apple may charge your Apple Account up to 24 hours before the current period ends.

You can manage or cancel subscriptions in your Apple Account subscription settings. A lifetime purchase is a one-time, non-consumable purchase; it is not a subscription and does not include a free trial.

Use BrainShift’s Restore Purchases option to restore eligible purchases made with the same Apple Account. Apple and RevenueCat manage purchase validation and entitlement access; restoring a purchase does not recover local BrainShift data.

Refunds and billing

Apple processes payments, billing, cancellations, and refund requests for purchases made through the App Store. To request a refund, use Apple’s Report a Problem service or contact Apple Support. Nothing in these Terms limits any refund, cancellation, or consumer rights you have under applicable law.

Availability and changes

We may update, modify, suspend, or discontinue BrainShift features when reasonably necessary for security, legal compliance, platform changes, maintenance, or product improvement. We will not intentionally remove paid access in a way that conflicts with applicable law or Apple’s applicable purchase terms.

We do not guarantee that every feature will be available at all times or on every device, operating-system version, or region.

Intellectual property

BrainShift, its software, designs, and related content are owned by Chipmunk Studio or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms and Apple’s applicable terms, we grant you a limited, personal, non-transferable right to use BrainShift on devices you own or control.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of BrainShift except where applicable law permits it.

Disclaimers and liability

BrainShift is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the extent permitted by law, Chipmunk Studio is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, BrainShift. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Consumer rights and governing law

These Terms do not limit consumer protections that cannot be waived under applicable law. If you are a consumer, mandatory laws in your country or region of residence may give you additional rights and take precedence where they apply.

To the extent permitted by applicable law, any dispute relating to these Terms will be handled by a court with jurisdiction under the applicable law. Before starting a formal dispute, please contact us so we can try to resolve the issue.

Changes to these Terms

We may update these Terms when BrainShift, its purchase options, or legal requirements change. We will post the revised Terms on this page and update the “Last updated” date. If a change materially affects your rights, we will provide additional notice where appropriate.
